For foreign investors, developers, equipment suppliers and non-resident directors, the opportunity sits in utility-scale solar and wind, distributed generation, free-market contracts, ethanol and other biofuels, biomass, biogas and adjacent grid services. PCREPS lists Sustainable Energy among the sectors it supports and presents itself as a trusted local partner for foreign investors in Brazil. The sector should be read through outorga, connection, land and a Brazilian company, not through slogans about green growth.

Official energy statistics show why the country remains on global renewable maps. According to the Ministry of Mines and Energy and the Energy Research Office (EPE), in the release of the Relatório Síntese do Balanço Energético Nacional 2025 (ano-base 2024), dated 29 May 2025, renewables accounted for 88.2% of Brazil’s electricity mix in 2024; wind and solar together were 23.7% of total generation; distributed micro and mini generation (MMGD) was 5.6%; solar photovoltaic generation reached 70.7 TWh and 48,468 MW of installed capacity; wind reached 107.7 TWh and 29,550 MW. According to EPE, in BEN 2026 | Relatório Síntese | Ano base 2025, the 2025 electricity mix was 86.8% renewable; solar reached 88.1 TWh and 64,793 MW; wind reached 116.5 TWh and 34,707 MW; the two sources together were 26.4% of generation; total electricity generation was 775,896 GWh; thermal generation was 169.9 TWh, of which 38.9% came from biomass. According to the Ministry of Mines and Energy, in the Boletim Mensal de Monitoramento do Sistema Elétrico Brasileiro – Março de 2026, total installed generation including MMGD reached 265.1 GW at the end of March 2026; MMGD reached 47 GW, or 17.6% of capacity, up 22.5% in 12 months; the capacity table listed 34,828 MW of wind, 68,726 MW of solar, 51,226 MW of thermal and 110,266 MW of hydro, with 46,369 MW of solar in MMGD. According to the International Energy Agency, on the Brazil electricity page consulted on 25 September 2026, hydropower was 56% of Brazilian electricity generation in 2024, a figure that should not be mixed with EPE’s methodology without reconciliation.

The investment routes are several, and none is automatic. Utility-scale solar and onshore wind require resource studies, connection, environmental licensing and, above 5,000 kW, ANEEL authorisation. According to ANEEL, on the page Outorgas, updated on 15 May 2025, wind, solar and thermal plants above 5,000 kW need an authorisation outorga; smaller plants follow registration or communication according to their class. Law No. 14,300 of 6 January 2022 is the legal framework for distributed micro and mini generation and the Electricity Compensation System. According to ANEEL, on Micro e Minigeração Distribuída, updated on 9 June 2026, microgeneration is up to 75 kW and minigeneration is above 75 kW and up to 3 MW, with hypotheses up to 5 MW; credits last 60 months; modalities include local self-consumption, remote self-consumption, multiple units and shared generation. Auctions remain a regulated-market tool, not a requirement for every plant. According to MME, in the March 2026 bulletin, two reserve-capacity auctions in March 2026 contracted 19 GW of power for system security — a capacity product, not a solar or wind offtake. The same bulletin recorded the first 2026 transmission auction with five lots, R$ 3.3 billion of planned investment and 798 km of lines. Bioenergy is a parallel industrial route. According to EPE, in Análise de Conjuntura dos Biocombustíveis 2025, ethanol output reached 36.2 billion litres in 2025, the second-highest result in the series; the mandatory biodiesel blend rose to B15 from August; 40.1 million CBIOs were retired, 99% of the CNPE target. According to MAPA, in the 2025/2026 cane, sugar and ethanol production file updated on 13 May 2026, accumulated output to 1 April 2026 included 36,919,923 cubic metres of ethanol and 663,816,981 tonnes of cane. This content is general and informational; it does not replace legal, regulatory, tax or engineering advice.

The corporate and land layer is where many international plans stall. Direct investment into a Brazilian company or special-purpose vehicle is, in principle, the ordinary route. According to DREI, in the manual Sociedade Estrangeira, a foreign company as shareholder of a Brazilian company is not the branch case of Civil Code article 1,134 and is registered before the Board of Trade. A branch, agency or establishment of the foreign company itself requires prior Executive Branch authorisation under article 1,134 of Law No. 10,406 of 10 January 2002 and DREI Normative Instruction No. 77 of 18 March 2020. According to the Central Bank of Brazil, on the page Prestação de informações de capitais estrangeiros no país, foreign direct investment is reported through SCE-IED; the September 2026 declarant manual states that recipients with total assets of at least R$ 300 million and any non-resident participation must file a quarterly declaration for events after 1 October 2024. If non-resident directors remain on the Brazilian vehicle, Law No. 14,195 of 26 August 2021, amending article 146, paragraph 2, of the Corporation Law, requires a representative resident in Brazil, with powers for at least three years after the end of the term of office to receive service of process. Plants need land. Law No. 5,709 of 7 October 1971 restricts acquisition of rural property by foreigners and by Brazilian companies controlled by foreign capital. Lease, surface rights or easements should not be presumed to fall outside that analysis.

That is the practical meaning of local partnership in this sector. A foreign energy investor does not only need a megawatt thesis. It needs a Brazilian SPE or authorised branch, a registered office address, lawful representation of non-resident investors and directors, capital reported to the Central Bank, ANEEL or biofuel authorisations as the case may be, and a land file that can support the plant. PCREPS offers company formation, legal representation of foreign investors and non-resident directors, administration of subsidiaries and branches, provision of a registered office address, representation in public tenders, DPO services, compliance and integrity support, treasury support, and liquidation and custodial services. It also connects clients to a network of law firms, accountants, financial advisers and other specialists. None of this replaces ANEEL, ANP, ONS, CCEE or environmental authorities, and none of it guarantees connection, licences, prices or investment returns. It does reduce the most common source of delay: developing a plant before the Brazilian vehicle, the outorga path and the land analysis exist.

If you are assessing solar, wind, distributed generation, ethanol or a grid-services company in Brazil, the next step is diagnostic rather than promotional. Map the source, the connection, the land constraint, the corporate form and the reporting of foreign capital before capital is committed.
